SAFE Terms of Service

Effective Date: November 1st, 2025

Acceptance of Terms

These Terms of Service ("ToS") constitute a legally binding agreement between you ("User" or "you") and SAFE Trust Company ("Company," "we," "us," or "our"). By accessing, browsing, or using the website located at and all its subdomains (collectively, "the Website"), you acknowledge that you have read, understood, and agree to be bound by these ToS and to comply with all applicable laws and regulations. If you do not agree to these ToS, you must not access or use the Website.

Definitions

(a) "Company" refers to SAFE Trust Company, a Wyoming Public Trust, with its principal place of business at Cheyenne, Wyoming.

(b) "User" refers to any individual, company, or other legal entity accessing or using the Website for any purpose.

(c) "Website" refers to the web pages located at the root URL, and all related subdomains, content, and services provided by the Company thereon.

Eligibility

You must be 18 years old to use the Services and represent that you are of such age in doing so. If you are using the Services on behalf of a legal entity, you further represent and warrant that the legal entity is duly organized and validly existing under the applicable laws of the jurisdiction of its organization, and you are duly authorized by such legal entity to act on its behalf.

Furthermore, you represent and warrant that you meet the following requirements:

  • You have not previously been suspended or removed from using our Services
  • You have full power and authority to enter into this Agreement and in doing so will not violate any other agreement to which it is a party
  • You are not located in, under the control of, or a national of any restricted location or any country to which the United States have embargoed goods or services
  • Neither you or any authorized person has been identified as a "Specially Designated National" by OFAC
  • No one employed by you or who is an investor or principal has been placed on the U.S. Commerce Department's Denied Persons List
  • You will not use our Services if any applicable laws in the country of its incorporation or operation prohibits you from doing so in accordance with this Agreement

SAFE may not make all the Services available in all markets and jurisdictions and may restrict or prohibit use of all or a portion of the Services from certain countries, states, territories, or jurisdictions.

Limited Scope

These ToS apply exclusively to your access to and use of the Website and the Content (as defined in Article 3) provided thereon. These ToS do not govern, and are not intended to govern, the provision, sale, purchase, or use of any of the Company's primary products or services.

Services

As a Wyoming Trust Company organized under the laws of Wyoming, SAFE is authorized to act as a custodian and hold in custody and bailment pursuant to Wyo. Stat. § 34-29-104(d)(ii), certain supported digital assets, which will remain at all times separated from the Company's property.

Separate Agreements for Services

All products and services offered by the Company are provided to clients pursuant to a separate, legally binding agreement, such as a Master Service Agreement (MSA) or other similar client contract (collectively, "Service Agreements"). The rights and obligations of the parties with respect to such services are defined exclusively in the applicable Service Agreement.

Precedence of Service Agreements: In the event of any conflict, inconsistency, or ambiguity between these Terms of Service and any executed Service Agreement, the terms, conditions, and provisions of the Service Agreement shall control and prevail in all respects.

Intellectual Property

Ownership

The Website and all its contents, features, and functionality—including but not limited to all information, software, source code, text, graphics, logos, button icons, images, audio clips, video clips, data compilations, and the design, selection, and arrangement thereof (collectively, the "Content")—are the exclusive property of the Company, its licensors, or other content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Trademarks

The trademarks, logos, and service marks displayed on the Website (collectively, the "Trademarks") are the registered and unregistered marks of the Company, its affiliates, or its licensors. Nothing contained on the Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark without the prior written permission of the Company or such third party that may own the Trademark. Your misuse of the Trademarks displayed on the Website, or any other Content on the Website, is strictly prohibited.

Limited License

The Company grants you a limited, revocable, non-exclusive, and non-transferable license to access and make personal, non-commercial use of the Website. This license does not include any right to:

  • Resell or commercially use the Website or its Content
  • Collect and use any product or service listings, descriptions, or prices
  • Make any derivative use of the Website or its Content
  • Download (other than page caching) or copy account information for the benefit of another merchant
  • Use data mining, robots, spiders, or similar data gathering and extraction tools

Explicit Restrictions

The Website or any portion of the Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express prior written consent of the Company. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Company without express written consent. You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of the Website so long as the link does not portray the Company, or its products or services, in a false, misleading, derogatory, or otherwise offensive manner.

User Account

In order to use some of the services provided by the Company, you'll need to create an "sFOX Account" through our partner sFOX Inc. You must open the said "sFOX Account" provided by sFOX Inc. ("sFOX") and accept the sFOX Terms of Service and the sFOX Privacy Policy.

You authorize SAFE Trust Company to collect and share with sFOX your personal information, including: full name, email address and financial information, and you are responsible for the accuracy and completeness of that data. You understand that you will access and manage your sFOX Account through the Website, and any sFOX Account notifications will be sent by the Company, not sFOX. We will provide customer support for your sFOX Account activity, and can be reached at [email protected].

Acceptable Use

You agree to use the Website only for lawful purposes and in accordance with these ToS. The Website is intended to provide information about the Company's services and to provide a secure access portal for registered clients.

Prohibited Conduct

You agree not to, and will not assist or permit others to, use the Website to:

  • Violate any applicable local, state, national, or international law, rule, or regulation
  • Infringe upon or violate the intellectual property rights of the Company or any third party
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the Website or any software, documentation, or data related to the Website
  • Use any robot, spider, scraper, or other automated means to access the Website for any purpose without our express written permission
  • Impose an unreasonable or disproportionately large load on our infrastructure, or otherwise interfere or attempt to interfere with the proper working of the Website
  • Attempt to gain unauthorized access to the Website, the client portal, other user accounts, or computer systems or networks connected to the Website through hacking, password mining, or any other means
  • Post, transmit, or otherwise make available any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, fraudulent, invasive of another's privacy, or otherwise objectionable
  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature
  • Use the Website for any commercial solicitation purposes
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity

Disclaimers and Warranties

"AS IS" AND "AS AVAILABLE" BASIS

THE WEBSITE AND ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE WEBSITE ARE PROVIDED BY THE COMPANY ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.

DISCLAIMER OF ALL WARRANTIES

THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE WEBSITE OR THE INFORMATION, CONTENT, MATERIALS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE WEBSITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE WEBSITE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NO WARRANTY OF UNINTERRUPTED SERVICE

THE COMPANY DOES NOT WARRANT THAT THE WEBSITE, ITS SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM THE COMPANY ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE COMPANY DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT THE COMPANY HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Termination

The Company reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Website, with or without notice, for any reason, including, without limitation, for any conduct that the Company believes violates these ToS, is harmful to other users of the Website, the Company, or third parties, or otherwise violates applicable law.

Governing Law and Jurisdiction

Governing Law: These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of Wyoming, without regard to its conflict of law principles.

Jurisdiction: You agree that any legal action or proceeding arising out of or related to these ToS shall be brought exclusively in the state or federal courts located in Wyoming. You hereby irrevocably consent to the exclusive jurisdiction and venue of such courts.

General Provisions

Severability

If any provision of these ToS is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the ToS will continue in full force and effect.

Entire Agreement

These ToS constitute the sole and entire agreement between you and the Company regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.

Changes to Terms

The Company reserves the right, in our sole discretion, to revise and update these ToS from time to time. All changes are effective immediately when we post them. Your continued use of the Website following the posting of revised ToS means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

No Waiver

This Agreement shall not be construed to waive rights that cannot be waived under applicable governing laws where you are located.

E-Sign and Electronic Communications Consent

In our sole discretion, any agreements, applications or records that you sign or agree to at our request may be in electronic form. Furthermore, you agree and consent to receive electronically all communications, agreements, documents, notices and disclosures (collectively, "Communications") that we provide in connection with the Services offered by the Company and the use of the Website.

We will provide these Communications to you by either posting them on the Website, emailing them to you at the primary email address listed in your profile, communicating to you via instant chat, and/or through other electronic communication, such as a text message or mobile push notification.

We are likely unable to send Communications in a language other than English, and if you are not fluent in English, you should consider obtaining the services of an interpreter. You understand and agree that if the Company or its agent sends you an electronic Communication but you do not receive it because either your phone number or primary email address on file are incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, we will be deemed to have provided the Communication to you.
